The contract between Tottenham and Harry Kane of Bayern Munich includes an unusual “gentleman’s agreement” provision.
Harry Kane’s contract with Bayern Munich includes a provision that Spurs can use to “match bids in the future,” according to transfer expert Fabrizio Romano.

After agreeing to a club record deal worth £86 million plus add-ons, Kane signed a lucrative four-year deal with the defending Bundesliga champions last summer.

An additional month down the road, Tottenham chairman Daniel Levy asserted that the club possesses a “buy-back clause” to re-engage their departed player.

Nevertheless, transfer specialist Fabrizio Romano has elaborated on the Spurs chairman’s use of the term “buy-back clause” since those claims surfaced.

“Daniel Levy has mentioned a buy-back clause for Harry Kane following Tottenham’s summer sale to Bayern Munich. I’d like to clarify some details with my sources and then provide as much information as possible on this,” Romano stated in an interview with Caught Offside, as reported by Football365.
Based on my conversations with various sources, some have dispelled this rumor, while others have confirmed it—albeit with some caveats that make it more than just a buy-back clause.

The clause in question does not permit Tottenham to re-sign Harry Kane at any time, according to those in the know about the negotiations. This is because it is not a conventional buy-back clause.
As Romano pointed out, “some sources have denied it, but others have confirmed it.” This means that Bayern has agreed to notify Tottenham in the future if they decide to sell Kane.

To keep Tottenham apprised of any offers or proposals, particularly from clubs in the Premier League, Bayern will formally contact the club.

No changes will occur on the player side when Tottenham has the opportunity to match any offers; in the end, Kane, and no club other than Spurs or any other, will decide his future.

If Bayern ever decides to sell the player, Tottenham will have the chance to match bids thanks to this gentleman’s agreement between the two clubs.
